Terms of Service
1. Definitions
- "Zavora 360," "we," "us," "our" — Royal Bengal AI, operator of the Virtual Customer Care platform.
- "Service" — the Zavora 360 platform accessible at zavora360.royalbengal.ai, including the Virtual Receptionist voice service, the customer dashboard, the admin panel, the WordPress plugin, and any related APIs and widgets.
- "Customer," "you," "your" — the individual or organization that signs up for an account.
- "End Caller" — a third party who interacts with your Virtual Receptionist by calling your phone number, clicking your web call link, or using the chat or outreach channels once they are available.
- "Content" — information you provide to the Service, including knowledge base documents, agent configuration, and any data extracted from calls.
2. Eligibility and Account Registration
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. By signing up, you confirm that the information you provide is accurate and that you have the legal authority to bind your organization to these Terms if signing up on behalf of one.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@royalbengal.ai if you suspect unauthorized access.
3. The Service
Zavora 360 provides a Virtual Customer Care platform that answers your customers' calls, chats, and outreach interactions 24/7 in multiple languages, trained on a knowledge base you provide. The currently available channels are described on our home page. Some features are live, some are in beta, and some are marked "coming soon" — only live features carry our service-level commitments.
We may add, change, or remove features at our discretion. Material changes that reduce functionality will be communicated to active Customers in advance where reasonably possible.
4. Plans, Billing, and Free Minutes
4.1 Plan Tiers
The Service offers Free, Standard, and Premium plans, with the option of custom plans for larger Customers. Plan features, monthly minute quotas, and pricing are displayed on our home page and are subject to change. Changes affecting active subscriptions will be communicated in advance.
4.2 Free Minutes
New accounts receive a quota of free minutes to evaluate the Service. Free minutes are non-transferable, expire on the schedule shown in the dashboard, and have no cash value.
4.3 Paid Plans and Top-Ups
Paid plans are billed in advance for the period stated at checkout. Minute top-ups are billed one-time and added to your usage pool as described in the dashboard. All payments are processed by Stripe; we do not store full card details.
4.4 Refunds
Subscription fees are generally non-refundable, but we will consider refund requests on a case-by-case basis for unused service, service outages caused by us, or billing errors. Contact support@royalbengal.ai within 30 days of the charge to request a refund.
4.5 Failed Payments and Suspension
If a payment fails, we will retry and notify you. If the issue is not resolved within a reasonable period, we may suspend account access. Suspended accounts retain their data for at least 30 days before any data deletion occurs.
5. Acceptable Use
You agree not to use the Service to:
- Engage in any illegal activity or violate any applicable law.
- Place calls in violation of telemarketing, robocall, or do-not-call laws in the jurisdictions where the calls originate or terminate. You are responsible for compliance with the U.S. TCPA, EU ePrivacy Directive, GDPR, and any equivalent regulations applicable to your campaigns.
- Send spam, harass anyone, or place calls without consent where consent is required.
- Impersonate any person or entity, or misrepresent your affiliation with anyone.
- Upload knowledge base content that infringes intellectual property, violates privacy rights, or contains malware.
- Attempt to access accounts or data that do not belong to you.
- Probe, scan, or test the vulnerability of the Service, or interfere with its operation, without our written consent.
- Use the Service to compete with us, including by extracting content to build a competing product.
- Resell, redistribute, or sublicense the Service without our written agreement.
6. Your Content
You retain all rights to the knowledge base content and configuration you upload. You grant us a limited, non-exclusive, royalty-free license to use, store, process, and display your Content solely to operate and improve the Service for you. We do not use your Content to train general AI models, and we do not share it with other Customers.
You are responsible for ensuring that you have the right to upload the Content you provide and that doing so does not violate any third party's rights.
7. Calls to End Callers and Recording Notices
When End Callers interact with your Virtual Receptionist, you — as the Customer who deployed the Receptionist — are the controller of those interactions and are responsible for any disclosures, consents, or notices required by applicable law (such as call-recording notices, two-party consent jurisdictions, or GDPR transparency requirements). We act as a processor for that data on your behalf.
For clarity: we do not store call audio. Only text transcripts are retained. You should still inform End Callers that conversations may be transcribed, recorded, or otherwise processed, as required by your jurisdiction.
8. The WordPress Plugin
The Zavora 360 WordPress plugin is provided under GPL v2 or later (matching the WordPress.org plugin directory requirement). The plugin transmits only your API key to our API endpoint and does not send visitor data to us until a visitor clicks the button and opens the Virtual Receptionist popup. Detailed data-flow information is available in the plugin's readme.
9. Service Availability
We aim for high availability but do not guarantee uninterrupted service. The Service may be unavailable during planned maintenance, due to issues with third-party sub-processors (Twilio, Deepgram, ElevenLabs, Google Cloud, Anthropic, Stripe, Supabase, Railway), or for reasons beyond our reasonable control. Where we provide an SLA in a separate written agreement, that SLA controls; otherwise the Service is provided on an "as available" basis.
10. Intellectual Property
The Zavora 360 platform, including its software, design, brand names, logos, and documentation, is owned by Royal Bengal AI and protected by applicable intellectual property laws. Except for the rights expressly granted in these Terms (and, where applicable, the GPL license covering the WordPress plugin), no rights are transferred to you. You may not copy, modify, reverse-engineer, or create derivative works of the Service except as permitted by law or by these Terms.
11. Termination
You may terminate your account at any time from the dashboard (Settings → Delete Account) or by emailing support@royalbengal.ai. Account deletion removes all associated data within 30 days, including transcripts, leads, knowledge base content, and any provisioned phone numbers.
We may terminate or suspend your account if you breach these Terms, if your account is used for prohibited activity, if required by law, or if the account is inactive for an extended period. Where reasonably possible, we will give you notice and an opportunity to remedy the breach before termination.
Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including Sections 6, 10, 12, 13, 14, 15, and 16) will survive.
12. Disclaimers
13. Limitation of Liability
To the maximum extent permitted by law, Royal Bengal AI's total aggregate liability arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) USD 100. We will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow exclusion or limitation of certain damages; in those jurisdictions, the limitations above apply only to the extent permitted.
14. Indemnification
You agree to indemnify and hold harmless Royal Bengal AI from any claim, loss, liability, or expense (including reasonable legal fees) arising from (a) your use of the Service in violation of these Terms or applicable law, (b) the Content you upload, (c) calls you place to End Callers, and (d) any third-party claim that your activity infringes their rights.
15. Governing Law and Disputes
These Terms are governed by the laws of Bangladesh, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved by the competent courts of Bangladesh, except where mandatory consumer-protection law in your jurisdiction provides otherwise.
Nothing in this section restricts your ability to bring a complaint with a relevant data-protection authority where you have that right under applicable law.
16. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date and notify active Customers by email at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree to the changes, you may terminate your account before they take effect.
17. Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and Royal Bengal AI regarding the Service.
- Severability. If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
- No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Notices. We may give you notices through the dashboard, by email to the address associated with your account, or by posting on the website.
